Please read these Terms of Use (EULA) ("Terms") carefully before using the WinPath mobile application and services operated by WinPath ("us", "we", or "our").

By accessing or using WinPath, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the service.

WinPath is a goal-tracking application that allows users to add entries for different people, set goals they want to achieve for each person, add notes, and receive AI-powered insights. The service is provided "as is" and "as available" for your use.

3. User Accounts

To use certain features of WinPath, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

4.1 Your Content

You retain ownership of any content you create, upload, or store in WinPath, including entries for people, goals you're tracking, and notes. By using the service, you grant us a license to use, store, and process your content as necessary to provide the service.

4.2 Content Restrictions

You agree not to use WinPath to:

• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, or offensive
• Violate any laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Transmit any viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the service or its systems

5. AI Features

WinPath may provide AI-powered features and suggestions. These features are provided for informational purposes only and should not be considered as professional advice. We do not guarantee the accuracy, completeness, or usefulness of AI-generated content.

6. Intellectual Property

The WinPath service, including its original content, features, and functionality, is owned by WinPath and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Prohibited Uses

You may not use WinPath:

• In any way that violates any applicable law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful

8. Service Availability

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We do not guarantee that the service will be available at all times or that it will be error-free.

9. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the service will cease immediately.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT SHALL WINPATH, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to defend, indemnify, and hold harmless WinPath and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the service or violation of these Terms.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WinPath operates, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
